These Business Terms and Conditions apply for shopping in the internet shop at www.penoxal.com. The Terms and Conditions specify in greater detail the rights and obligations of the seller (operator, supplier) and the buyer (customer, consumer). This internet shop is operated by the company

2. DEFINITION OF TERMS

A supplier/seller – is a person that in the course of the conclusion and performance of the agreement acts within the framework of his business or different entrepreneurial activities. He is an entrepreneur that supplies buyers with products either directly or via other entrepreneurs.

A customer of our internet shop is a buyer. In view of the valid legislation it is necessary to distinguish a buyer who is a consumer and a buyer who is not.

A buyer – consumer is a person that in the course of the conclusion and performance of the agreement does not act within the framework of his business or different entrepreneurial activities. He is an individual purchasing products for purposes other than carrying out business activities with these products or services.

A buyer – who is not a consumer is an entrepreneur that purchases products for the purpose of carrying out business activities with these products. This buyer is to observe the Business Terms and Conditions at the scope applicable to him and the Commercial Code.

Purchase Agreement – by placing an offer for the sale of goods on the website the seller expresses his will to enter into a Purchase Agreement for the goods under the specified terms and conditions. The Purchase Agreement is created at the point of the delivery of the binding order of the buyer to the seller. From that moment the mutual rights and obligations arise between the buyer and the seller and these are defined in the Purchase Agreement and the Business Terms and Conditions, which form an integral part of the Agreement.

Information about the Concluded Agreement and Business Terms and Conditions

By entering into the Purchase Agreement the buyer confirms that he has familiarised himself with these Business Terms and Conditions and agrees therewith. The buyer has been informed about these Business Terms and Conditions in a sufficient manner before actually making the order and has had an opportunity to read these. These Business Terms and Conditions form an integral part of the concluded Agreement.
The Agreement is concluded in English language, unless circumstances on the part of the seller or buyer exclude this. The Agreement may be entered into in a different language, understandable to both parties. The concluded Agreement is archived by the seller for the purpose of its successful performance and is not accessible to third parties. The information about individual technical steps leading to the conclusion of the Agreement is apparent from the ordering process in our internet shop and the buyer has the chance to check the order and possibly correct it before its actual submission. These Business Terms and Conditions are displayed on our internet shop website thus allowing their saving and reproduction by the buyer.

3. GOODS DELIVERY

•    Orders made and paid for online on business days (Mon-Fri) by 5 p.m. will be ready for dispatch to your address the following business day
•    Orders made on Friday after 12 noon + weekends will be ready for dispatch to your address the following Monday at the earliest

We deliver the ordered goods as a business parcel by Standard Post or by DHL delivery services. The supply of the subject of the Agreement will be performed as soon as possible, depending on the availability of products and the operational possibilities of the seller, usually within 2 - 5 business days, in exceptional cases the delivery period may be longer. When accepting the goods from the delivery service provider please always check whether the transport packaging is intact. If the packaging is damaged, please indicate this fact in the delivery record of the delivery service provider or Standard Post.

For orders of goods we charge a postage fee 10Euro! 
Delivery period 5-14 business days (depending on the country of delivery)

DHL express - 20Euro
Delivery period 2-4 business days (depending on the country of delivery)

4. PAYMENT TERMS AND CONDITIONS

All of the prices shown are final inclusive of VAT, which the consumer is bound to pay for the goods. Before placing the order the consumer has the opportunity to find out how long the price will be valid for.

All goods are delivered with a tax document. Until full payment is made, the goods remain the property of the seller. If the order or its part is cancelled on the part of the supplier (e.g. the goods are sold out), the sum of money or its relevant part is immediately remitted back to the bank account number, from which it was transferred, unless agreed otherwise.
The supplier reserves the right to make any and all changes in the internet shop including changes in the prices. Offers (including special offers, sales and leaflet promotions) are valid until sold out of stock. The price is valid at the time the order is made.

 

5. PAYMENT METHODS

• Payment by payment cards – safe payment by your payment cards - VISA, VISA electron, Maestro, MasterCard (by means of the secure 3D-Secure portal)
• PayU payments – safe on-line payment by means of the secure PayU portal from your bank account

If the buyer fails to accept the subject of the Agreement for reasons lying on his part (e.g. he is unable to settle the purchase price), the buyer will bear the costs connected with the repeated delivery in full.

Order cancellation by the buyer – the buyer is entitled to cancel the order at any time before the goods dispatch, without any recourse, by e-mail to info@penoxal.com.

You can cancel your contract with Sonowa Sp. z o.o. within 14 working days of delivery (starting the day after the receipt of the goods), as per the guidance set out in the Consumer Rights Act from May 30 2014 item 827.

 

6. PROTECTION OF PERSONAL DATA
Your personal data are confidential and will not be disclosed to anyone. The Sonowa Sp. z o.o. company guarantees that it does not sell, loan or provide your data in any other way to any third parties.

By registering in the internet shop www.penoxal.com you agree with:

• the processing of your personal data by the Sonowa Sp. z o.o. company for marketing purposes
• being sent shopping offers to your e-mail address (the maximum frequency of these offers will not be more than 1x/7 days), deregistration of your e-mail address is possible directly in the offer, or in your registration section

Personal data are protected in accordance with the Law of 29.08.1997 on the Protection of Personal Data (1997, No. 133, item 883) in such a way as to prevent third parties from accessing them.

Your Consent
By using the internet shop www.penoxal.com you grant your consent to the collection and use of information about you and your purchases for an indefinite period of time. Rules for handling these data are described in this document. If these rules are changed in the future, details of the new rules will be published on this website, therefore you will have an opportunity to learn about these.

Change and Deletion of Your Personal Data from the Registration Section / Mailing List
Should you decide to revoke your consent to the processing of personal data, you can simply phone our info-line or write to us at the following e-mail address: info@penoxal.com. Your registration will be changed or possibly deleted.
Should you decide to delete your e-mail contact from our mailing list, you can perform the deletion yourself, by clicking on the relevant link at the bottom part of each information e-mail or send us an e-mail at: info@penoxal.com requesting to be taken out from the list. You will be informed about your contact details having been removed from the list by an e-mail
